On 19 July 2016, the European Commission issued a provision ascertaining one of the largest cartels in European history. The Commission has sanctioned the trucks manufacturers MAN, Volvo / Renault, Daimler, Iveco and DAF for violating EU antitrust law for 14 years, from 1997 to 2011, distorting the truck market through collusive agreements consisting in price fixing and passing on part of the costs to client to comply with stricter emissions regulations.
The aforementioned truck manufacturers have admitted their involvement in the cartel and finalised the procedure with the European Commission which imposed the record fine of 2.93 billion euros. The Commission also initiated proceedings against Scania which had not agreed to settle, which ended on 27 September 2017 with a fine of over € 880 million for its involvement in the cartel.
With the decision on February 1, 2024, the Court of Justice of the European Union confirmed the mentioned sanction, opening up the possibility for cartel victims to take action against Scania even for trucks purchased from other suppliers, if they had not yet taken action to seek damages.
Companies and individuals who have purchased or leased trucks weighing more than 6 tons in the current period between 1997 and 2013, may be entitled to compensation for the damage suffered as a result of the cartel’s activity.
Libra offers companies and individuals who have purchased or leased medium and heavy trucks the exceptional opportunity to assign their potential compensation claim in exchange for compensation proportional to the number of trucks purchased during the cartel period and meeting eligibility criteria. Participants in the Libra Campaign will be able to immediately receive compensation for the assignment without having to pursue legal action against truck manufacturers and await the outcome of litigation.
The campaign will be active from April 1, 2024, until the available funding is exhausted.
