AGCM Sanctions: Unauthorized Surcharges in the Tourism Sector

The Authority for Competition and the Market has imposed total fines of €17,500 on the companies Take it slowly by un’altra Sicilia, Sicilying S.r.l., and TICKETSMS S.r.l.

The Authority found that the three companies applied surcharges related to the payment method used by consumers at the end of the purchasing process for services in the tourism and event ticketing sectors. In particular, these companies imposed a price supplement directly linked to the chosen payment method, violating the Consumer Code, which states that those receiving payment cannot impose charges on consumers for the use of specific payment methods.

The Antitrust observed that the behaviors of the three companies involved applying differentiated commissions based on the selected payment method, sometimes without specifying the amount.

These sanctions are part of a series of recent interventions by the AGCM against operators applying costs for the use of payment methods.

The regulations used in these proceedings aim to protect consumer rights in contracts and, together with other legal provisions prohibiting the application of surcharges, seek to achieve the European objective of creating a unified payment system.
